Legislative Update: Sexting
The Texas Legislature passed Senate Bill 407 which now creates a new criminal offense for minors who sext with another minor. Before the passage of this law, if a Texas teenager possessed and sent naked photos were treated and given the same punishment as child pornographers.
There has been a substantial amount of literature produced on child produced pornography. The old statute led to the absurd result discussed above, and the Texas Legislature is attempting to address the problem of self-produced child pornography. Now, there is a reduce crime and punishment range for tenn sexting. Sexting, of course, is when someone sends or receives sexually explicit images over cell phones.
Sexting is now a Class C Misdemeanor for a first offense. If the minor has prior offense then the offense can be enhanced to a Class A and B Misdemeanor. If you have been charged with a sex crime
