Right To A Fair Trial Continued.
As we noted yesterday, a fundamental part or requirement of due process is a fair trial. The Code of Criminal Procedure and the Texas Constitution objectives are to ensure that the accuse the right to a fair trial. It also requires an impartial jury to determine whether the defendant is guilty beyond a reasonable doubt.
The Courts mandate that a trial court and prosecutors ensure that the defendant is given a fair and impartial trial. The reason for this is obvious--if the system is going to convict someone and deprive them of his or her liberty, it is important that the defendant be given a fair trial.
The Supreme Court of the United States and the Court of Criminal Appeals has held that "the atmosphere essential to the preservation of a fair trial--the most fundamental of all freedoms--must be maintained at all costs." The courts have extended this logic to imposing a duty upon the trial court and the prosecutors to conduct themselves so as to ensure an accused individual receives a fair trial.
